Risk Assessment and Mitigation
How prepared is your NPA to face government scrutiny? We offer tailored consulting services to help AbilityOne NPAs strengthen compliance and prepare executives for government oversight, audits, and investigations. Our services include training sessions on the False Claims Act (FCA) and other enforcement priorities, how to prepare for investigative interviews, and the role and powers of different government agencies operating within the AbilityOne enforcement space.
We help AbilityOne NPAs identify and address compliance risks before they escalate into costly civil or criminal exposure. Our services include targeted risk assessments focused on key enforcement areas, including direct labor ratio compliance, medical documentation and Individual Eligibility Evaluations (IEEs), Procurement List product and service integrity, pricing practices, contractual obligations, and the use of affiliated healthcare providers.
False Claims Act and Gov't Enforcement Defense
When civil or criminal enforcement actions arise, we provide strategic support at every stage. We assist clients with responding to civil investigative demands (CIDs), administrative and grand jury subpoenas, strategy for preserving legal defenses, and preparation for interviews, depositions, and investigative meetings.
AbilityOne Procurement List Counsel
Our firm advises NPAs on AbilityOne Procurement List actions and disputes, including: CNA assignment and allocation appeals, Opportunity Notice responses, contractor impact assessments, and disputes involving PL additions, removals, or reassignments. We help NPAs navigate the evolving framework of Commission Policy 51.301 to protect and grow their PL work.
Internal Investigations
We help AbilityOne NPAs design and implement systems for receiving, investigating, and resolving employee complaints under Commission Compliance Policy 406 and FAR 52.203-13. Our services include conducting privileged internal investigations, performing credibility assessments, managing disclosure obligations to agency OIGs and contracting officers, and advising on risk mitigation strategies to lower liability exposure.
AbilityOne Program Entry & Reentry
We guide NPAs through the AbilityOne Program entry or reentry process in full compliance with Commission Policy 51.401. Our services include evaluating governance and related-entity structures, ensuring financial and operational independence, addressing prior compliance issues, preparing qualification documentation, and supporting required training. We help NPAs position themselves for long-term success and eligibility for Procurement List assignments.
